Why You Should Call An Attorney

Before You Settle Your Insurance Claim

Did you know that several studies performed both by independent research companies and by insurance companies themselves have determined that persons with claims for injury arising from the fault of the other persons or entities get substantially more money in their pocket when they are represented by legal counsel than when they resolve such claims with insurance companies themselves?

A highly respected Rand study indicates that people who retain lawyers receive more than four (4) times the amount of money in insurance settlements than those injured victims that negotiate directly with an insurance company.

A highly respected Rand study indicates that people who retain lawyers receive more than four (4) times the amount of money in insurance settlements than those injured victims that negotiate directly with an insurance company. This is because experienced legal counsel know how to generate the evidence that can cause the insurance company to increase the amount at which they evaluate the claim.

Insurance companies value claims for settlement purposes based upon a number of factors.

Insurance companies value claims for settlement purposes based upon a number of factors. One of the most important factors is what they think the likelihood of a particular dollar verdict will be which consideration ../../Includes the "venue" where the case has to be tried under the law. Venue is the jurisdiction, i.e., location, that is required to hear the case. It also is dependent upon the type of person the claimant is evaluated as by the insurance company.

Probably the most important factor is the evidence that the insurance company believes the claimant's lawyer will be able to present at trial. Often, what evidence will be able to be presented at trial on medical legal issues is not clear to the insurance company because the medical records do not always address the issues that are important for legal purposes.

Often, what evidence will be able to be presented at trial on medical legal issues is not clear to the insurance company because the medical records do not always address the issues that are important for legal purposes.

For example, whether or not an injury will cause a permanent affect on a person's body or activities of daily living or employment usually is not specifically addressed in the medical records.

However, the question of the permanency of any injury is a critical factor from an insurance company's perspective because in front of a jury the claimant's lawyer will be able to request compensation to cover the rest of the person's life since the person is living with the affects of that injury. If the insurance company is not given proper documentation of this issue, they will not provide any compensation in a settlement offer to cover it.

Another issue that doctors rarely address in the medical records is the issue of what amount of money is going to be required to pay for future medical expenses as a result of the injuries. Again, if the insurance company does not have that information, they will not provide any compensation for that type of damages. Therefore, it is critical that this information is addressed in writing by the doctors whom the insurance company understands will be testifying as experts in any trial of the claim. If it is, the insurance company values the claim higher.

Since experts are allowed to offer their opinions in a trial, a doctor's opinion as to the amount of future medical expenses and/or the permanency of an injury will be admissible at trial and will inflate the value of the claim. If the insurance company sees the issues addressed in the documentation that is provided to them in connection with the claim, it obviously means that they will value the claim higher.

At Mintz Law Firm, we regularly get documented information that claimants on their own will find difficult to get documented.

Because Mintz Law Firm LLC has been in practice in the Denver, Colorado, area for over twenty-four years and because we have made it a point to establish relationships with, network with and associate with quite a few board certified medical doctors of different specialties we can get this evidence quickly and completely and we have educated doctors about the needs of our clients, so we regularly get documented information that claimants on their own will find difficult to get documented.

Often, the doctor will not be willing to give an opinion to a patient that he would be willing to give to a lawyer with whom he has worked over a number of years and who he trusts and respects.

Mintz Law Firm LLC communicates very well with all clients so that they understand the issues in the case, how they need to be documented and what is being done to document them. We do the same with the doctors. This greatly benefits our clients and means they get more money.
