2008 Colorado Auto Insurance Changes
When you are hurt in a car accident, you can never have enough insurance coverage. So if you are hit by an uninsured or underinsured driver, Colorado’s new “Stacking” law can help you recover enough to compensate you for your injuries, losses and damages if you plan properly.
Many drivers in Colorado either have no insurance or the minimum liability limits of $25,000. Now, for policies that were written after January 1, 2008, you can get the full value of the underinsured motorist policy that you paid for. This is in contrast to the policies that were written prior to January 1, 2008, in which your underinsured motorist carrier was given a credit or offset for the liability coverage for the at fault driver. The caveat in the law is that it only applies to “policies written after January 1, 2008” and not all car wrecks after January 1, 2008. Therefore, you may want to renew your policy so that it is written after January 1, 2008, to get the benefit of the new law.
An example of how the new law works will help you understand how good this is for Colorado drivers. Now, if a careless driver has Colorado’s minimum limits of $25,000, and you have $100,000 in Underinsured Motorist Coverage, your maximum recovery could be $125,000 under the new law. If you compare that to the old law, which did not allow “stacking,” your maximum recovery would be only $100,000 because insurance companies were able to credit or offset the difference between the two policies. Under the new law that allows stacking, Colorado drivers finally get the full value of the Underinsured Motorist benefit that they paid for and deserve.
Stacking your underinsured motorist coverage can be a life saver because it may allow you to pay all of your medical bills and get the money that you deserve for your injuries and losses.
